Service Agreement

Think Pawsitively Dog Behavior, Training, & Consulting

I agree to contract with Think Pawsitively Dog Behavior, Training, and Consulting for services pursuant to the terms of this Service Agreement. 

PAYMENTS: To provide the best possible outcomes, Think Pawsitively requires a commitment to a full training plan. Payment may be paid in full prior to the first scheduled session or via a payment plan of half up front and the remainder halfway through the purchased package. To provide high-quality, effective programs, Think Pawsitively utilizes an intensive training method that requires commitment on the part of both trainer and client. Should I choose to cancel my training package, I understand I am responsible for paying my entire training plan fee. Training outside Missoula may accrue a travel fee per visit, roundtrip.
CANCELLATIONS: Think Pawsitively goal is to provide you with the best chance of reaching your training goals. Training consistency is paramount to training success. Training plans are strategically and intentionally designed and scheduled to achieve the best possible outcomes over a specified timeframe. Therefore, cancellations are not recommended, and make-up sessions will be rescheduled at the full session fee. Consistency is a key ingredient to training success. Should COVID, inclement weather, mild illness, or other unpredictable circumstances make training in person impossible or unsafe, Think Pawsitively reserves the right to move your scheduled training session(s) online to protect your training progress, my schedule, and the ability to serve you and others. Online training has proven to be an effective and powerful modality. Such changes in service are not grounds for cancellation, postponement, or refund.
PACKAGE PURCHASE COMPLETION: All sessions in a package must be completed within 4 months of the first scheduled session. Sessions not completed within this time period will be forfeited unless otherwise agreed upon. 

MANAGEMENT PLAN: Because following your management plan at all times is so critical to both your safety and your training success, failing to do so risks the cancellation of your package without a refund. If you experience difficulty staying with your management plan, Think Pawsitively urges you to let us know immediately so we can work together to find a solution. Our ability to help you reach your goals and experience true relief may be severely limited without this teamwork.
EXPECTATIONS: Dog behavior is dynamic and always changing. Think Pawsitively provides the most updated training, and positive reinforcement methods, and works closely with you and your dog to impart animal behavior knowledge that best fits your needs as well as your dog's needs. Behavior modification and training takes time, consistency, and commitment. You play a very important role in practicing and continuing to reinforce behaviors that have been learned through training. Behaviors are not static, and dogs will not continue to perform even trained behaviors without ongoing practice, especially in cases involving any type of aggression. I agree and commit to doing my part in implementing training and management as directed by the trainer. Although behavior may be modified, I understand dogs are never considered “cured.” I also understand that a dog’s behavior and/or interaction with humans and other animals is ultimately my responsibility. Think Pawsitively will make every reasonable effort to help me attain my goals but makes no guarantees of performance on the part of me or my pet(s). I will assume full responsibility for keeping and/or rescheduling appointments, ongoing communication, and practice.
PHOTO & VIDEO RELEASE: I hereby consent to my dog being the subject of photographs and/or audiovisual recording and authorize Think Pawsitively and Rhonda Hamerslough to cause the same to be exhibited for public dissemination, advertisement, or educational purposes as still photographs, transparencies, motion pictures, television, video, or other similar media. Pet(s) name(s) may be shared publicly. 
WAIVER OF LIABILITY AND INFORMED CONSENT RELEASE:
I, the undersigned, have enrolled myself and my dog in training or other related activities offered by Think Pawsitively Dog Behavior, Training, and Consulting. By signing hereunder, I certify that I have been informed and understand that there is always some unavoidable risk of injury involved when working with animals, especially animals with behavioral issues. I acknowledge that dogs can be inherently difficult to control and that not all dogs will always be under control resulting in the possibility of injury to myself, my dog, my family members, or third parties. I understand that my pet(s) may be exposed to a variety of situations which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, uneven or slippery surfaces, crowds, and all types of traffic.
Additionally, I have had the full opportunity to discuss all concerns I have about the foregoing risks with Think Pawsitively and its authorized representatives. I have also made all inquiries and investigations to my satisfaction related to such risks, including, but not limited to an examination of the training area and an examination of vehicles for transport (if applicable).
I agree to assume full financial/moral/legal responsibility for the past, present, and future actions of my pet(s). As lawful consideration for participating in training, for myself, my heirs, executors, administrators, legal representatives, successors, and assigns (the “Releasing Party”), hereby waive, release, discharge, and agree not to take any legal action against Think Pawsitively and to indemnify, defend and hold harmless Think Pawsitively, its owner, Rhonda Hamerslough, and their members, managers, agents, and employees (the “Released Party”) from any and all injuries, losses, claims, and damages to any person or persons of any nature whatsoever, including claims arising from the Released Party’s own negligence, and all costs associated therewith, including attorney’s fees, court costs, and consultant fees, arising from my participation in this Service Agreement. This Waiver of Liability and Informed Consent Release shall be legally binding on the Releasing Party. Should the Releasing Party assert a claim contrary to what has been agreed to in this Waiver of Liability and Informed Consent Release, the Releasing Party shall be liable for all expenses (including attorney’s fees, court costs, and consultant fees) incurred by both the Releasing Party and the Released Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party.
